Terms of service

1 · What we agree to

Every project starts with a written scope: what we will make, what it costs, and when it lands. Once you accept it in writing (a reply to our email is enough), that scope plus this page is the agreement. Anything not listed in the scope is not included, and we will quote it separately rather than assume.

2 · Prices and payment

The rate card on our site is a guide; the scope carries the real number. All prices are in US dollars and exclude any local taxes that apply to you. A 50% deposit starts the work and the balance is due on delivery. Retainers are invoiced monthly in advance, carry a three-month minimum, and take 10% off if a quarter is paid up front.

Advertising spend is separate. It is paid by you, directly to Google, Meta, TikTok or LinkedIn, and never passes through us. Management fees quoted as a percentage of spend are calculated on the spend for that month.

3 · Revisions

Two rounds of revisions are included on every deliverable. A round means one consolidated set of changes, sent together. Further rounds, or a change of direction after a draft has been approved, are quoted as extra work before we start them.

4 · Timelines and what we need from you

Dates in the scope assume you supply content, brand assets, account access and feedback when asked. If material or approval is outstanding, the date moves by roughly the same amount of time. If a project goes quiet for more than 60 days we may invoice for the work completed and close it; picking it up again later is fine and costs nothing extra beyond re-scoping if things have changed.

5 · Ownership and handover

On final payment, everything we made for you is yours: editable source files, website code and content, graphics, video exports, and the accounts and logins we set up. Accounts are created in your name wherever the platform allows it, and our own access is removed on request.

Two exceptions. Third-party assets (stock photography, fonts, plugins, themes) stay under their own licences, and we will tell you which ones a project depends on. And you agree we may show the finished work in our portfolio and on social media unless you ask us in writing not to.

6 · Your content

You confirm you have the right to use everything you send us (logos, photos, footage, copy, product claims) and that our using it on your behalf will not infringe anyone else's rights. We will not knowingly publish anything misleading or unlawful, and we may decline work that a platform's policies would reject.

7 · What we do not promise

We promise care, craft and honest reporting. We cannot promise specific rankings, traffic, leads or sales; those depend on your market, pricing, budget and competitors as much as on our work. Platforms also change their rules and algorithms without notice. Where something outside our control breaks a result, we will tell you plainly and propose the fix.

8 · Ending things

Retainers can be ended by either side with 30 days' written notice once the three-month minimum has passed. For one-off projects, cancelling after work has begun means the deposit is not refunded and any work completed beyond it is invoiced. You keep whatever has been delivered and paid for.

9 · Liability

Our total liability for any claim connected to a project is limited to the fees you paid us for that project in the preceding three months. We are not liable for lost profits, lost data or indirect losses. Nothing here limits liability that cannot legally be limited.

10 · Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute. Before anyone goes near a court, though, message us; nearly everything is fixable in a conversation.
